RennovEN Ensure Terms

1. Nature of the Service

RennovEN Ensure is an independent advisory and monitoring service. We inspect, verify and report on construction work so that you can make informed decisions and require your contractor to correct defects.

We do not act as your contractor, builder, architect of record or structural engineer of record, and we do not direct, manage or supervise the contractor’s workforce, methods or site safety.

2. Scope

The Service covers only the stages, visits and checks listed in your Engagement, which may include:

• Review of drawings, specifications, BOQ and contract provided by you.
• Stage-wise site inspections at agreed milestones.
• Verification of materials against specified brands, grades and quantities.
• Verification of contractor bills and measurements against the BOQ.
• Photo and video progress reports.
• Handover and snag inspection.

3. Your responsibilities

• Share current drawings, specifications, BOQ and contract documents, and tell us of any changes.
• Give us reasonable notice (ideally two to three working days) of critical stages such as slab pours.
• Arrange site access and inform your contractor of our role.
• Decide on and instruct your contractor about any corrective action.

4. Contractor’s responsibility

Your contractor remains solely responsible for the design execution, workmanship, materials it supplies, site safety, statutory compliance and timely completion of the construction. Our inspections do not transfer, reduce or share any of the contractor’s responsibilities.

5. Limits of inspection

Inspections are visual and non-destructive, carried out at the time of the visit on the work then visible and accessible. Stages we were not notified of, or work covered before our visit, cannot be inspected. Material testing is carried out only if specifically agreed, through accredited laboratories, at actual cost.

6. Reports

Reports record our observations and recommendations as of the date of inspection. They are prepared for you and may be shared with your contractor and lender. They are not a structural stability certificate, a completion certificate or a statutory approval.

7. Warranty

Because the construction is carried out by your contractor, the RennovEN 10-year warranty does not apply to it. If you later engage RennovEN to rectify, complete or carry out any works, those works are covered by our Warranty Policy.

8. Fees and payment

Fees are based on built-up area, number of stages or visits and location, as set out in your Engagement, and are payable as stated there under our Payment Terms. Additional visits or re-inspections requested beyond the Engagement are charged separately.

9. Cancellation

You may end the Engagement at any time by written notice. Fees for visits completed and reports delivered are payable; advance payments for visits not yet carried out are refunded as per our Cancellation & Refund Policy.

10. Liability

Our total liability for any claim relating to the Service is limited to the fees paid for the Service in the Engagement. We are not liable for defects, delays, cost overruns or losses caused by the contractor or others, or for indirect or consequential losses. Nothing here limits liability that cannot be limited under Indian law.

11. Disputes

Please raise concerns first with our Grievance Officer. These terms are governed by the laws of India and, subject to your rights as a consumer, disputes are subject to arbitration seated at Lucknow, Uttar Pradesh.
